1. ACCEPTANCE OF TERMS

By accessing or using the BTO Analysis website at btoanalysis.com ("Website"), or by using our Sun Analysis service ("Service"), you ("User" or "you") agree to be bound by these Terms of Use ("Terms"). If you do not agree to these Terms, do not use the Website or Service.

2. ELIGIBILITY

You must be at least eighteen (18) years of age to use the Website or Service. By using the Website or making a purchase, you represent and warrant that you are at least 18 years old and have the legal capacity to enter into a binding agreement. If you are under 18, you may only use the Website or Service with the involvement and consent of a parent or legal guardian, who agrees to be bound by these Terms on your behalf.

3. ABOUT THE WEBSITE AND SERVICES

BTO Analysis is owned and operated by Thy Ventures Pte Ltd, a company incorporated in Singapore ("Company," "we," "us," or "our"). The Website provides sun direction and sun exposure analysis tools for HDB BTO projects in Singapore.

We provide a Sun Analysis ("Service") where users can purchase detailed sun exposure analysis for specific units in upcoming BTO projects, including personalised floorplan analysis showing how sunlight reaches each room.

4. ACCURACY DISCLAIMER AND LIMITATIONS

4.1 No Guarantee of Accuracy

4.2 User Responsibility

You acknowledge and agree that:

• You use the Website and Service at your own risk and discretion
• You should not rely solely on the Service for critical property purchase decisions
• You are responsible for verifying all sun analysis information through alternative means and professional consultation when accuracy is crucial
• Any analysis provided is based on available information and our interpretation thereof

5. LIMITATION OF LIABILITY

THE WEBSITE AND SERVICE ARE PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, WHETHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, ACCURACY, RELIABILITY, PROFESSIONAL COMPETENCE, OR NON-INFRINGEMENT.

5.2 Limitation of Damages

IN NO EVENT SHALL THY VENTURES PTE LTD, ITS DIRECTORS, OFFICERS, EMPLOYEES, AGENTS, OR AFFILIATES BE LIABLE FOR ANY:

• Direct, indirect, incidental, special, consequential, or punitive damages
• Loss of profits, data, use, or other economic advantage
• Personal injury, property damage, or death
• Financial losses arising from property purchase decisions
• Damages arising from your use or inability to use the Website or Service
• Damages resulting from reliance on sun analysis information provided by the Service
• Costs associated with property modifications or construction decisions
• Professional consultation fees or remedial work costs
• Loss of property value or missed opportunities

This limitation applies regardless of the theory of liability (contract, tort, negligence, strict liability, or otherwise) and even if we have been advised of the possibility of such damages.

5.3 Aggregate Liability Cap

NOTWITHSTANDING ANYTHING TO THE CONTRARY IN THESE TERMS, IN THE EVENT THAT ANY COURT OR TRIBUNAL OF COMPETENT JURISDICTION DETERMINES THAT LIABILITY CANNOT BE FULLY EXCLUDED, THE TOTAL AGGREGATE LIABILITY OF THY VENTURES PTE LTD FOR ALL CLAIMS ARISING OUT OF OR RELATING TO THE USE OF THE WEBSITE OR SERVICE SHALL NOT EXCEED THE TOTAL AMOUNT PAID BY YOU TO THE COMPANY IN THE TWELVE (12) MONTHS IMMEDIATELY PRECEDING THE EVENT GIVING RISE TO THE CLAIM, OR FIFTY SINGAPORE DOLLARS (SGD 50.00), WHICHEVER IS GREATER.

6. INDEMNIFICATION

You agree to indemnify, defend, and hold harmless Thy Ventures Pte Ltd, its subsidiaries, affiliates, directors, officers, employees, agents, and representatives from and against any and all claims, liabilities, damages, losses, costs, expenses (including reasonable attorneys' fees), arising out of or relating to:

• Your use or misuse of the Website or Service
• Your reliance on sun analysis information provided by the Service
• Any activities, construction, modifications, or decisions made based on information from the Service
• Your violation of these Terms
• Your violation of any applicable laws or regulations
• Any third-party claims arising from your use of the Website or Service
• Property purchase decisions or outcomes based on our Service
• Claims by contractors, architects, or other professionals regarding work performed based on our analysis

7. PAYMENT TERMS AND REFUND POLICY

7.1 Pricing and Payment

• All prices are displayed and charged in Singapore Dollars (SGD)
• Prices are inclusive of any applicable taxes unless otherwise stated
• Payments are processed securely through Stripe, a third-party payment processor. By making a purchase, you also agree to Stripe's Terms of Service
• We reserve the right to change our pricing at any time. Price changes will not affect purchases already completed

7.2 Digital Goods and Refunds

The Sun Analysis is a digital product. Once a purchased analysis has been delivered (i.e. made accessible to you on the Website), the purchase is considered fulfilled and is non-refundable.

We may, at our sole discretion, offer a refund or credit in exceptional circumstances, such as:

• A technical error that prevents you from accessing your purchased analysis
• A duplicate charge for the same unit

To request a refund, contact us at support@btoanalysis.com within fourteen (14) days of purchase.

8. PROHIBITED USES

You agree not to use the Website or Service:

• For any unlawful purpose or in violation of applicable laws
• As a substitute for professional architectural, engineering, or solar design services
• For final construction or installation decisions without professional verification
• For commercial construction projects without appropriate professional consultation
• In situations where building codes, permits, or regulatory compliance is required

9. USER RESPONSIBILITIES

9.1 Appropriate Use

You acknowledge that:

• The Sun Analysis provides general guidance and recommendations that should be verified before use
• Any construction, modification, or installation decisions should involve appropriate professional consultation
• You should obtain necessary permits and approvals before making property modifications
• Our Service does not constitute professional architectural, engineering, or solar design advice

10. PRIVACY AND DATA

10.1 Data Retention

11. INTELLECTUAL PROPERTY

The Website and its content, features, and functionality are owned by Thy Ventures Pte Ltd and are protected by international copyright, trademark, patent, trade secret, and other intellectual property laws.

11.2 Purchased Analysis Licence

When you purchase a Sun Analysis, you are granted a limited, non-exclusive, non-transferable, personal licence to access and use the analysis for your own private, non-commercial purposes. You may not:

• Redistribute, resell, sublicense, or make the analysis publicly available
• Use the analysis for commercial purposes, including but not limited to property agency marketing materials
• Reproduce or extract the analysis content in bulk for any purpose

12. MODIFICATIONS TO TERMS

We reserve the right to modify these Terms at any time. We will notify users of any material changes by updating the "Last Updated" date. Your continued use of the Website after such modifications constitutes acceptance of the updated Terms.

13. TERMINATION

We may terminate or suspend your access to the Website or Service immediately, without prior notice, for any reason, including breach of these Terms. Upon termination, your right to use the Website ceases immediately, though you will retain access to any previously purchased analyses for a reasonable period to allow you to retrieve them.

14. FORCE MAJEURE

We shall not be liable for any failure or delay in performing our obligations under these Terms where such failure or delay results from circumstances beyond our reasonable control, including but not limited to: natural disasters, pandemics, government actions or restrictions, internet or telecommunications failures, server or hosting outages, cyberattacks, power failures, or disruptions to third-party services we rely upon (including but not limited to Firebase, Stripe, or cloud infrastructure providers).

15. DISPUTE RESOLUTION

15.1 Informal Resolution

Before initiating any formal proceedings, you agree to first contact us at support@btoanalysis.com and attempt to resolve any dispute informally within thirty (30) days.

15.2 Governing Law and Jurisdiction

These Terms shall be governed by and construed in accordance with the laws of Singapore, without regard to conflict of law principles. If informal resolution is unsuccessful, any disputes arising under these Terms shall be subject to the exclusive jurisdiction of the courts of Singapore.

16. SEVERABILITY

If any provision of these Terms is held to be invalid or unenforceable, the remaining provisions shall remain in full force and effect.

17. ENTIRE AGREEMENT

These Terms constitute the entire agreement between you and Thy Ventures Pte Ltd regarding the use of the Website and Service and supersede all prior agreements and understandings.
